New security rules in the American airports. The board control officers have obtained the right to copy data from the personal notebooks and cellphones of all people coming to the USA.
Guardian and the Mirror write about it with the link to the decision of the 9-th arbitrage USA court that has been taken already in the end of April. This court has revoked the decision of the previous instance not to take into consideration the data found on the personal notebook (it was the matter of child pornography, found on the notebook of one of the tourists) as the evidence. At that time the judge Dean Pregerson has stated that electronic data storage devices are "are an extension of our memories and thoughts" and cannot be searched without grounded suspicion.
Now this decision has been revoked. This means that at the entrance to the USA at the border control all the data (even confidential) can be copied from every electronic device and the device itself can be confiscated for several days. Guardian notes that you could try to encrypt your data, but during the check the representatives of the authorities could ask you to show the contents of the crypted data. The representatives of the Symantec company, that produces antivirus solutions warn: this procedure can make the tourists wait for weeks at the border. |
